It is an interesting photo, and I would tend to agree with your view that it could be the tree. I don't know if you have the ability to go back to the same location or not, but as a reference photo, put a live person in the same area to see how it matches up. Plus, you can check to see if in fact there is a tree there.

close up of the area.. dunno maybe.. just sooo far away I personally think its a tree, my crew-mate who took it on the other hand thinks its an apparition
